Berg Cautiously Optimistic on Eve of Election
On a day which saw another eligibility-related lawsuit, this one in Connecticut, bite the dust, Philadelphia attorney Philip Berg remains cautiously optimistic after taking his own dismissed case to the highest court in all the land.
"At this point, we're waiting and hoping and praying that Justice Souter rules in our favor and delays tomorrow's election," said Berg, mentioning as well that he filed a supplemental argument with the Court today. "They have the power. The United States Supreme Court has the power. They stopped the count in Florida in 2000, I was there in the panhandle when they stopped the count."
As has been written in these pages before, the odds are extremely long that Berg's case is given an audience with the Supreme Court, as only 70 to 120 of the 8,000 or so petitions are granted, and the odds are infinitely longer that Berg's emergency motion is granted.
"The odds are slim," Berg said. "If the election goes on tomorrow as planned, we start going after the Electoral College on Wednesday. December 15 becomes our deadline. There's still time. The Electoral College requires that a candidate be eligible, so we're not stopping, that's for sure."
Unless, of course, Obama does not prevail tomorrow, in which case Berg says that he will continue his efforts "to bring out the truth about the fraud perpetrated against this nation."

Barack Obama's Grandmother Dies
Reuters is reporting that Madelyn Dunham lost her battle with cancer today, on the eve of the day when her grandson could very well be elected 44th president of the United States. While I certainly hope that he does not win tomorrow's election, and while I generally have a laissez-faire approach to moderating comments here, I will not tolerate inappropriate comments about Ms. Dunham.
Barack Obama may be many things, but aside from his ideology, with regard to this news he is simply a man who just lost the woman who was responsible for finally putting consistency in what had been an undoubtedly nomadic and inconsistent childhood.
I know the timing of his visit to Hawaii seemed strange. I know there are unanswered questions about his past. One thing, however, we know for certain -- Madelyn Dunham passed away today. Let's be respectful, okay?

I believe in you Phil Berg. No matter what happens keep running. if you hear the dogs barking keep going. If they are getting close keep going.
I will tell you a secret. You can always tell it was gods intervention with a miracle when it happens at the last minute. God always waits until the end before providing what is needed. That might simply be advice or inspiration. It might be someone jumping in to help with legal help or money. etc.

Is Mr Berg off his meds or something? I'm a psychiatric nurse practitioner and work at a locked crisis unit in Miami. Alot of my patients are more sane than Berg. Talk about narcissism, delusions of grandeur and possibly a fictitious disorder. Anybody looking at the polls,who's not mentally ill, knows that mccain cannot win this. The numbers just aren't there. Karl Rove just predicted an Obama win with 330EV. When Rove says you're going to lose, it's all over but the whining. PS when you see Mr Berg, remind him to get his risperdal level checked, his color looks horrible.

HOORAY FOR BERG and his tenacity in trying to prove that which should not be an issue in the first place.
I admit to being very naive in thinking that our courts and especially the Supreme Court would uphold the Constitution that governs us. When they were appointed to this life-time position, did they suddenly go brain-dead regarding their duties to We, the People? The entire Supreme Court should be replaced; however, they will envoke the law that says we can't. That is the only law they will ever uphold. Making hard decisions is beyond their pay grade.
And they are not the only ones. The lower courts do the same thing. We have absolutely no voice in anything any more.
Thank goodness there's still an option available in the Electoral College.
I'm very hesitant to believe that the the Supreame Court will grant his motion and/or hear his case, but if he still has a month or so to go after the Electoral College, perhaps there's still hope.
I for one will be voting first thing tomorrow even though my state is notorious for leaning democratic.

It is unreal to me that I work for the Federal Government and I had to go through a security background check before I was hired. I might add, I had to show a copy of my birth certificate, along with being finger printed. Why aren't people running for any office subjected to the same process? I don't even deal with national security and some of them do!!
It also is unreal to me that with all of this voter's fraud going on and we can't stop this election, clean house and start again. I've seen it, but for the life of me cannot find any record of the case in the Virginia courts, in the newspapers, or anywhere else. "Wild Bill," who provides nary a case number or judge's name, has not returned any of the e-mails I've sent his way.
From his description of the decision, I'd like to read it. Until I see a case number, however, I'm not sure it's really out there. I mean, given the disposition, there's no reason to doubt it, but I'd at least like a case number.

API cancels deal with Fox News Network on the Michelle Obama tape

The Michelle Obama tape has caused a great deal of headache to API from the day the story broke out. Some have argued saying API does not have the tape, whereas others have given API unwavering support all along. It is to the group that believed in API, that is owed an explanation to let them know what is going to happen after we cancel the deal with Fox News Network.
There is no exaggeration when we say we struck a deal with Fox N.N in good faith and that was done due to information we had at the time causing us to believe that the network was serious to air the tape.
API has waited this long for the release of the tape, while at the same time giving hope to many who wanted to listen to the contents of the tape.
We will not drop the idea to release the tape to the public because we are well aware API's credibility has been put on the line.
The truth of the matter, the negotiations and the denials must be put into perspective. API would like to inform the readers that we concentrated all our energy on the API/Fox arrangement because the readers advised us to do so.
It is important to point out that it was Fox News Network that took the initiative to establish contact with us and made us believe in them. When we did not want to continue negotiations with them, they kept on requesting for a deal and their persistence made us bestow our trust upon them in all totality.
The moment the story of the tape was made public by API, Fox News Network was quick to take contact requesting to be given exclusive rights. It took many days of negotiations and finally, API decided to accept Fox News Network's offer giving the network exclusive rights on the story.
In the deal, Fox News Network was contracted to air the tape anytime after the 28th of October and no later than the 4th of November. The general consensus and understanding was to have the tape released within 24 hours after the final agreement was reached. The agreement opens for change on the airing time but emphasises that if such was to happen due necessity and workload in the Network, the tape is to be aired anytime but not after the elections.
The delay by Fox to air the tape has caused API a lot of inconveniences, unnecessary embarrassment and as a result this has now forced API's to take this unilateral decision to declare the contract null and void after consultations with Counsel.
As a result of today's meetings and discussions with the legal team, API has send a letter of cancellation of the deal to Fox N.N., informing them of a breach of contract and intended move to seek compensation for a breach of contract.
Fox News Network can only save the deal if the Network promptly takes a decision to air the tape tonight without any failure.

If McCain loses, we must all swear on a stack of Bibles to not let this die. As much as some despise or fear BHO, there are much MUCH worse people than him. Obama's grandmother in Hawaii died of cancer today.
It seems as though "Wild Bill" has also been elusive to Berg's attempts to contact him, as stated by Berg's assistant. "Wild Bill" made the statement he attempted to contact Mr. Berg, to no avail, therefore went ahead and posted his Virginia findings. He states the Judge has seen the Birth Certificate. As you stated Jeff, without the Judge's name, or case number.
Who knows what happens now....but one thing is certain, Obama has a couple of skeltons in his closet.
For what it's worth and at this late point, maybe that's nothing but Obama was definitely friends with Ayers BEFORE they served together on the Woods Foundation.

I just heard that Obama's grandmother just passed away. I am sorry for Obama, but I hope this does not sway any votes to him because of sympathy. (I feel quilty just thinking that!)
After McCain wins tomorrow, I will still support the continued lawsuit to determine Obama's citizenship status. If he was adopted by Soetoro and he never applied for US citizenship, he would be an illegal alien - just like his aunt. He would not be qualified to be a US Senator either.
America needs to know - one way or the other - just what Obama's citizenship is. I hope at some point, there will be enough interest to check into his checkered background in Chicago.

I guess Mr. Berg will have to do all the legwork and teach the judge the important points of having a qualified person verify Obama's birth certificate. The person from Hawaii did not say Obama was born in Hawaii, they said his birth certificate was there. They also did not say if it was a certificate of live birth or a registration of birth - two totally different things! Start teaching, Mr. Berg! This can't end until the answer is uncovered. Obama may not even be eligible to serve as U.S. Senator!

Usually in such cases for elderly individuals a relative holds a Medical Power of Attorney, and at some point a decision is often made to cease all treatment except for palliative care. I find myself wondering if, and if so when, such a decision might have been made for Ms. Dunham.

Also, i have read that members of the electoral college can look up his records of birth, adoption, passport, etc to make sure he is eligable bc that is their job. Just today I found a useful article that explains the difference between a Certificate of Live Birth, and CERTIFICATION of live birth.
A Certificate of live birth is signed by the doctor attending the birth and is forwarded to the Bureau of health. It will give location date and time of birth.
A CERTIFICATION of live birth is not created in the hospital.... it can be created in many ways. It includes the possibility that you present the DOH with a foreign certificate of birth, and they will generate the CERTIFICATION based on that.
So a CERTIFICATION of live birth - as was posted on the internet - is not proof of natural borne status in and of itself.

After having searched for all I could, I think Wild Bill is an Obama plant and his case totally bogus.
He never gave one searchable detail - and it seems that would be easy in VA - with just a little information. His description on Berg's site of the judges opinion was eloquent - but every Obama dream come true.
Now he plans to continue the fight to Congress - that after tomorrow will be overwhelmingly liberal.

As we have seen in previous election cycles, the exit poll results do leak early and that ends up influencing the coverage of the race before even the first state polls close at 6:00 PM Eastern.
However, we want to remind the campaign that the media’s own post-election study of the exit polls in 2004 showed that the exit polls overstate the Democratic candidate’s support. Therefore, we would discourage a rush to judgment based on the exit polls and wait until there has been a representative sampling of actual tabulated results from a variety of counties and precincts in a state.
Here are the key points to keep in mind when the exit poll data starts being leaked:
1. Historically, exit polls have tended to overstate the Democratic vote.
2. The exit polls are likely to overstate the Obama vote because Obama voters are more likely to participate in the exit poll.
3. The exit polls have tended to skew most Democratic in years where there is high turnout and high vote interest like in 1992 and 2004.
4. It is not just the national exit poll that skews Democratic, but each of the state exit polls also suffers from the same Democratic leanings.
5. The results of the exit polls are also influenced by the demographics of the voters who conduct the exit polls.
After the 2004 election, the National Election Pool completed a study investigating why the exit polls that year showed John Kerry over performing 5.5 net points better than the actual results showed him to have done. Their conclusion was that the primary reason the exit polls was that Kerry voters and Democrats were more likely to participate in the exit polls.
“Our investigation of the differences between the exit poll estimates and the actual vote count point to one primary reason: in a number of precincts a higher than average Within Precinct Error most likely due to Kerry voters participating in the exit polls at a higher rate than Bush voters. There has been partisan overstatements in previous elections, more often overstating the Democrat, but occasionally overstating the Republican.
We believe that this will hold true this year. The recent Fox News survey showed that 46% of Obama voters said they were very likely to participate in the exit polls, while just 35% of McCain supporters are.
In fact, even the 2004 exit poll report noted that higher turnout nationally and higher levels of voter interest in both 1992 and 2004 correlated with greater Within Precinct Error.
The overstating of the Democratic vote did not only occur in the national exit polls, but also occurred in the state exit polls. The 2004 exit poll report cited that the Kerry vote was overstated by more than one standard error in 26 states, while the Bush vote was overstated in just four states. So we should also expect the individual state exit polls on Tuesday to be more Democratic as well.
So given that turnout is expected to be even higher than 2004 and that Democrats are more likely to participate in the exit polls, this means we should expect greater fluctuation and variation in the exit polls from the actual election results.
The 2004 exit poll report also showed that the greatest error in the exit poll came in precincts where the interviewer was younger. The completion rates were lower and the refusal rates and Within Precinct Error was higher when the interviewers were under the age of 35.[6] Complicating this is that nearly half the interviewers were under the age of 35, including 35% who were 18-24 and another 15% were 25-34.
Conclusions
Based on the previous exit poll results, we should expect once again that Tuesday’s exit poll data could overstate the Obama vote and under represent the McCain vote.
It is important that the campaign make sure the media realizes this, so that when the exit polls do leak, people do not overreact to the early exit poll data. Rather than looking at the exit polls, we should wait until we start seeing actual election results from key precincts and counties to gauge who won the election.

I tend to believe API's claims regarding Fox News. Fox News is NOT a "we report, you decide" NEWS AGENCY. Look at all the things Fox News did not report on this election season. Yes, Obama's birth certificates he will provide will be "authentic" but that does not mean that the facts written on Obama's birth certificates are true!!!
With the names of the people who certified these birth certificates in Hawaii, I would not be surprised to hear that a few of them are illegal immigrants!!! And therefore, it would not be that difficult for these certifiers of birth certificates in Hawaii to make an "authentic" birth certificate for Obama that is based on false facts!!
For instance, Obama's birth certificate would say that Obama was born at hospital X and such a birth certificate would be "authentic"!! The problem is that the records at hospital X have been dishonestly tampered to include Obama's birth at this particular hospital X when, in fact, Obama was never ever born at this hospital X in Hawaii!!!
Conclusion: even an Obama's certified birth certificate (full or partial) that is fully "authentic" does not mean that it is the end of the story! As a matter of fact, that is just the beginning of the deceptive story!!

Notice to cancel the deal to air the Michelle Obama tape was send yesterday the 3rd of November to Fox News Network’s Senior Counsel Cassidy. API expected a reaction from Fox N.N but got none and that opens the way for API to look for other means to have the tape aired.
Now that API has got no reaction from Fox News network, it is to be assumed that they are not ready to act tonight. API Counsel is now in the final stages in his arrangements to try and have Michelle Obama tape aired one way or another as soon as it is practically possible in collaboration with willing partners that he is now negotiating with as we go to press.
For us in API, we now have to leave things to the lead counsel who, together with his colleagues, will take all necessary steps so that the tape is released within the legal framework and in accordance with the laws of the United States.
After we issued the last bulletin informing the readers that API was cancelling the deal, some readers who would like to see the tape released immediately have been very critical on us. It is very important that when one is releasing sensitive information there is absolute need to be very careful because of the repercussions that may follow.
We should not forget that politics is a very deadly game and can hit back very hard on those who have information that may lead to disqualification of ambitious and non-ambitious candidates.
API, even through the pressure mounted has been high, had to thread very carefully. The tape contains highly sensitive information and what API and the legal advisers have been doing the whole day is to ensure API does not get hurt in the end or faced with many lawsuits to be initiated by those affected with the contents of the tape.
The fact that the legal team wants API to thread very carefully is because API risks being sued if when releasing the information is not careful enough in blocking any loopholes that enable those mentioned in the tape to take legal action.
This however, does not mean the tape will not be released. The people who do not want to believe,
- that API is speaking the the truth,
- that API has had agreement with Fox since the 28th of last month,
- that API is not lying to the readers, fooling any one, or trying to scam any persons, are at liberty to leave the site instead of complaining all the time and accusing API of malice.
Nobody is holding the legs of those complaining forcing them to come to the site here. Readers have a right to choose where to get information and if some readers do not believe in us and are only interested to call us Fraudsters, scammers and other dirty names, such people know only too well that they can decide not to visit our site at all. We will not miss them, if they do not visit this site at all, because they must not assume that their presence here is giving us any financial gains. Instead, we have to endure disrespect and abuse all the time, even after allowing non-moderation commenting system.
Some have become professional abusers on the site and some are professional doubters. When people call for the release of the tape, we understand them, but they should understand us as well when we tell them that we have to do so in a manner that does not kill API. To accuse us is that we may have written a letter to a non-existing Fox News Counsel is unbelievable.
We have communication between API and Fox News Network headquarters. If there was no truth in all this, we would have called it quit. The readers may become witnes to all the correspondence from the 15th October to the 1st of November between API and Fox News Network if the need arises.
To continue abusing me and calling me all kinds of names on earth does not make me stop what I am focused on. Those writing bad about me must now get it in their heads that calling me all sorts of names will not change the person I am and will not take my friends who know me away from me, because what is written by some readers about me is simply an attempt to discredit this site, a thing that they will not succeed.
I am not able to update the readers every hour now that the lawyers are working on the Case, but I will not relent until the tape is made public. In the finality of all this, API may end up asking for support from you, but for now the legal team have the control of things and they may not need any help from any one in putting their act together in seeing through what is to be done as immediate as possible.
My silence does not mean ignoring those who support API at this moment. It is just that the legal team have decided that they do the job because they are of the opinion that all I do is releasing a lot of inside information that may be used against API.
I would like to inform those who are against me and API, that when all this is over, despite their abuses, name calling and all the negative they have directed towards me, I will still remain here in API executing my duties deligently because I am a strong-will person who does not get shaken easily because I draw my strength from God who loves you and me.

If Fox had those tapes and they were authenticated, they would have aired them.
If these tapes were authentic, anyone (not the MSM obviously) would have been thrilled to play them.
Rush Limbaugh might even have put down a cigar to play them.
The fact is, if these tapes existed, API could have posted them on the net, like the recent breaking coal comments of Barry's.
Once on the net, it would go viral.
API has been good for a laugh anyway.

I am so very sad for our country that I am on the verge of tears. I just read that my fellow Catholics voted in majority for Obama, despite the fact that Obama supports not only abortion, but the withholding of medical care to those poor victims of "attempted abortion" who manage to survive the carnage. Jeff, please keep up the great work on the citizenship issue. I, as a lawyer, am outraged that Obama has been able to withhold showing the vault copy of his birth certificate and that the MSM hasn't followed up on the Isotero adoption. Do you know if anyone is poised to interview Sarah Obama tomorrow, since that's when she will supposedly be able to grant interviews again (although of course now she's been prepped completely). Sorry for the rambling...I am just distraught and praying that at least one of the "called" states will turn out to be wrong.
