Obama Sued in Philadelphia Federal Court on Grounds he is Constitutionally Ineligible for the Presidency

A prominent Philadelphia attorney and Hillary Clinton supporter filed suit this afternoon in the U.S. District Court for the Eastern District of Pennsylvania against Illinois Sen. Barack Obama, the Democratic National Committee and the Federal Election Commission. The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.
Philip Berg, the filing attorney, is a former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. According to Berg, he filed the suit--just days before the DNC is to hold its nominating convention in Denver--for the health of the Democratic Party.
"I filed this action at this time," Berg stated, "to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.".
Berg cited a number of unanswered questions regarding the Illinois senator's background, and in today's lawsuit maintained that Sen. Obama is not a natural born U.S. citizen or that, if he ever was, he lost his citizenship when he was adopted in Indonesia. Berg also cites what he calls "dual loyalties" due to his citizenship and ties with Kenya and Indonesia.
Even if Sen. Obama can prove his U.S. citizenship, Berg stated, citing the senator's use of a birth certificate from the state of Hawaii verified as a forgery by three independent document forensic experts, the issue of "multi-citizenship with responsibilities owed to and allegiance to other countries" remains on the table.
In the lawsuit, Berg states that Sen. Obama was born in Kenya, and not in Hawaii as the senator maintains. Before giving birth, according to the lawsuit, Obama's mother traveled to Kenya with his father but was prevented from flying back to Hawaii because of the late stage of her pregnancy, "apparently a normal restriction to avoid births during a flight." As Sen. Obama's own paternal grandmother, half-brother and half-sister have also claimed, Berg maintains that Stanley Ann Dunham--Obama's mother--gave birth to little Barack in Kenya and subsequently flew to Hawaii to register the birth.
Berg cites inconsistent accounts of Sen. Obama's birth, including reports that he was born at two separate hospitals--Kapiolani Hospital and Queens Hospital--in Honolulu, as well a profound lack of birthing records for Stanley Ann Dunham, though simple "registry of birth" records for Barack Obama are available in a Hawaiian public records office.
Should Sen. Obama truly have been born in Kenya, Berg writes, the laws on the books at the time of his birth hold that U.S. citizenship may only pass to a child born overseas to a U.S. citizen parent and non-citizen parent if the former was at least 19 years of age. Sen. Obama's mother was only 18 at the time. Therefore, because U.S. citizenship could not legally be passed on to him, Obama could not be registered as a "natural born" citizen and would therefore be ineligible to seek the presidency pursuant to Article II, Section 1 of the United States Constitution.
Moreover, even if Sen. Obama could have somehow been deemed "natural born," that citizenship was lost in or around 1967 when he and his mother took up residency in Indonesia, where Stanley Ann Dunham married Lolo Soetoro, an Indonesian citizen. Berg also states that he possesses copies of Sen. Obama's registration to Fransiskus Assisi School In Jakarta, Indonesia which clearly show that he was registered under the name "Barry Soetoro" and his citizenship listed as Indonesian.
The Hawaiian birth certificate, Berg says, is a forgery. In the suit, the attorney states that the birth certificate on record is a forgery, has been identified as such by three independent document forensic experts, and actually belonged to Maya Kasandra Soetoro, Sen. Obama's half-sister.
"Voters donated money, goods and services to elect a nominee and were defrauded by Sen. Obama's lies and obfuscations," Berg stated. "If the DNC officers ... had performed one ounce of due diligence we would not find ourselves in this emergency predicament, one week away from making a person the nominee who has lost their citizenship as a child and failed to even perform the basic steps of regaining citizenship as prescribed by constitutional laws."
"It is unfair to the country," he continued, "for candidates of either party to become the nominee when there is any question of the ability to serve if elected."

Recently FactCheck representatives got a chance to spend some time with the birth certificate, and we can attest to the fact that it is real and three-dimensional and resides at the Obama headquarters in Chicago. We can assure readers that the certificate does bear a raised seal, and that it's stamped on the back by Hawaii state registrar Alvin T. Onaka (who uses a signature stamp rather than signing individual birth certificates). We even brought home a few photographs.

The certificate has all the elements the State Department requires for proving citizenship to obtain a U.S. passport: "your full name, the full name of your parent(s), date and place of birth, sex, date the birth record was filed, and the seal or other certification of the official custodian of such records." The names, date and place of birth, and filing date are all evident on the scanned version, and you can see the seal above.
The document is a "certification of birth," also known as a short-form birth certificate. The long form is drawn up by the hospital and includes additional information such as birth weight and parents' hometowns. The short form is printed by the state and draws from a database with fewer details. The Hawaii Department of Health's birth record request form does not give the option to request a photocopy of your long-form birth certificate, but their short form has enough information to be acceptable to the State Department. We tried to ask the Hawaii DOH why they only offer the short form, among other questions, but they have not given a response.
The scan released by the campaign shows halos around the black text, making it look (to some) as though the text might have been pasted on top of an image of security paper. But the document itself has no such halos, nor do the close-up photos we took of it. We conclude that the halo seen in the image produced by the campaign is a digital artifact from the scanning process.
We asked the Obama campaign about the date stamp and the blacked-out certificate number. The certificate is stamped June 2007, because that's when Hawaii officials produced it for the campaign, which requested that document and "all the records we could get our hands on" according to spokesperson Shauna Daly. The campaign didn't release its copy until 2008, after speculation began to appear on the Internet questioning Obama's citizenship. The campaign then rushed to release the document, and the rush is responsible for the blacked-out certificate number. Says Shauna: "[We] couldn't get someone on the phone in Hawaii to tell us whether the number represented some secret information, and we erred on the side of blacking it out. Since then we've found out it's pretty irrelevant for the outside world." The document we looked at did have a certificate number; it is 151 1961 - 010641.
Isn't it just a matter of checking Hawaii's records? If Obama forged the birth certificate, Hawaii will not have a matching copy in their records.
As for having the kid and flying to the US to register the birth, well, that is different.
But there should be no debate about the (in)authenticity of the birth certificate.

McCain and Obama aren't in the same boat - McCain was never registered as a citizen of another country as far as I know; his parents were both American citizens.
Obama's parents were NOT both American citizens, his birth is registered in numerous places - two hospitals in Hawaii and in Mombasa Kenya, and on the registration for school in Indonesia he's called "Barry Soetoro", an Indonesian citizen.
He is legally, in fact, Barry Soetoro, not Barack Hussein Obama...and that brings up numerous other questions.--For example, when he received his degrees, under what name did he receive them? What name is his driver's license under, etc.?
The courts should be able to sort it out; I just hope they get a judge who's not someone's pocket.

i just did a search of the eastern district of pennsylvania docket (i'm a lawyer in philadelphia and have access to the PACER u.s. federal court service). there doesn't seem to be any lawsuit filed this week against obama, the DNC, or by anyone named berg.

one can NOT be "deemed" a Natural Born Citizen. You are or you are not. One can only be Naturalized.
This distinction is evident in the Constitution itself. Natural Born Citizen or a Citizen at the time of the adoption. That means Natural Born or naturalized.
Any law that declares, deems, etc any person to be a citizen is a naturalization statute. Period.
That means McCain is not eligible. Obama- yet to be determined.
Neither candidate is eligible. "Natural Born" has been rightfully interpreted by the Supreme Court to mean born in one of the States of the Union and nothing else. Since neither were, they are not eligible. If they are only eligible because of a law Congress passed, rather than the FACT of beig born in one of the States, then by very definition, they are NATURALIZED citizens, not NATURAL BORN. The fact that Congress had to pass a resolution making McCain a citizen is an act of NATURALIZATION. Neither is eligible. Sorry.

I am truly astonished at how many of you morons can't differentiate between dual citizenship for regular citizens, even high ranking officials, and the office of the President, which is Constitutionally required *not* to have any previous or conflicting loyalties. The President CANNOT be the citizen of another country and he can't have been born as a citizen of another country. Period. If (and I mean if) that is the case with BO, there's not getting around it. He's not eligible.
Also, McCain is a natural born citizen because both of his parents were citizens. What Dunham could have done *if it were possible* (and what McCain's parents did) was register the birth with the US consulate or other US authority such as, I don't know, a military base. Both of my aunts were born at civilian hospitals in Germany, but they're both "natural-born" US citizens nonetheless.
As of the 1980's BO was an Indonesian citizen, including having an Indonesian passport he used to visit Pakistan. So there is an issue.

No, McCain is not ineligible. He is a natural born citizen; being born in the US has only a little to do with it. Anyone born overseas to two US citizens is a US citizen; they just need to register the birth with a US consulate or other authority. Both of my aunts were born in civilian German hospitals, but they are both natural-born US citizens.

"Natural Born" means a citizen continuously from birth. The Constitution doesn't specify who is eligible at birth, it leaves it for laws to be passed to make that dtermination. All the Constitiution specifies is that a method be created for a person to become a naturalized citizen after being born, and that those people aren't eligible to run for president.
For example, my youngest son was born on an American military base in Germany. He has absolutely no claim to German citizenship and has been as U.S. citizen from day one. He, like McCain is completely eligible.

Just read that the emergency temporary restraining order or whatever order Berg wanted to stop Obama's nomination over citizenship has been denied. But the issue can be brought up again once all parties have been served.

If I recall correctly, McCain was born on a U.S. military base. So it doesn't matter whether it's in Panama or Timbuktu... it's U.S. Government property and is legally and jurisdictionally considered by all international law as being part of the United States... not part of Panama.
A U.S. military base is no different than a U.S. Embassy. If you're in either one, anywhere in the world, you're in the United States.

Yes, a lot of people speak out like they know something when they're TOTALLY ignorant. The Constitution does NOT say you have to have been born in one of the FIFTY states. How did the framers know we'd end up with FIFTY? Objectively, which is how a court SHOULD decide, McCain is undoubtedly natural-born. Obama? Definite questions. And who says this has been vetted??? SO MANY things are definitely up in the air until a suit is brought and the courts decide upon it (Roe v. Wade, Brown v. Board of Ed., et. al.)
First, I'm one of many Independents who believe McCain is CLEARLY the better candidate.
Having said that, here's one comment on the Constitution: it reads, "natural born citizen or citizen at the time of the adoption of this Constitution." That's how Washington, Adams, Jefferson, Madison, Monroe, Adams, and Jackson were eligible. There was no United States when those people were born. Same is true for McCain. LOL. ;^)

Any person born in the US, it's POSSESIONS and under the jurisdiction of the US is a natural born citizen. The hospital in the Canal Zone was in a US possesion and suject to US jurisdiction
Ever since Obama entered the race, I have raised the question, where is the original certificate of birth, the photostatic copy, black background, white letters, on photographic paper, that would have been issued by the Records Department of Hawaii?
At the time of Obama's birth, this is the type of record that would have been issued and given to the mother or parents.
Find the official record, solve the issue.

Hi my name is Samuel Browning, and I wish to start off by saying that while I am a registered Democrat, I am not affiliated with the Obama campaign in any manner.
The claim that Obama has falsified a birth certificate is based on the analysis of allegedly three "experts" including one "technodude" who claims expert status but is unwilling to disclose his real name.
In court proceedings, (where this matter has now ended up) there is no such thing as anonymous expert testimony. The expert either provides his name in addition to his report, or his contribution will not even be accepted as part of any filed motion.
Until Technodude decides to disclose his identity, and Philip Berg discloses the expert witnesses upon whom he is basing his assertions, this lawsuit, to put it mildly is grossly speculative.
Please double check this assertion by calling your family lawyer and asking him whether he or she could ever file a civil suit in any court in the United States and introduce the testimony of an anonymous expert witness without having the judge laugh her, or him, out of court.

Berg makes a compelling case, especially where it concerns loyalty even if it is "proved" that Obama was born in Hawaii; having later been an Indonesian citizen, Obama would have had to document taking an oath before a public official pledging loyalty to the U.S. in order to regain his purported erstwhile American citizenship. Absent such documentation, and in light of a preponderance of evidence pertaining to the other points of the suit, Obama is NOT Constitutionally qualified to run for President, because his citizenship is dubious at best.

Where ever Barry O' was born, when he was adopted by Lolo Soetoro in Indonesia and given his name, his nationality and his religion, Barry O' LOST any other citizenship because Indonesia doesn't recognize dual citizenship. And Lolo Soetoro had no reason to lie when he registered Barry in both Primary Schools as "Barry Soetoro, Indonesian Citizen, Islam Religion." Unless Barry Soetoro was adopted by his Dunham Grandparents when he returned to Hawaii at age 10, he is STILL a citizen of Indonesia. Unless he legally changed his name from Barry Soetoro to Barack Hussein Obama, Jr (II), then his legal name is still Barry Soetoro.
Allegedly, Barry O' used his Indonesian Birth Certificate to obtain the Passport he used in 1981 to visit his mother in Indonesia and a friend in Pakistan. He knew he was not a US Citizen in 1981, which leads to the conclusion that his Dunham grandparents did NOT adopt him.
It's already been proved that since Stanley Ann Dunham was underage when she had Barry, he cannot be a Natural Born US Citizen by the Standards set forth in the Constitution for Presidential Candidates. And if her parents did not adopt him, then he doesn't even have US Citizenship. The implications of this are enormous. He was not a US Citizen when he received grants and loans for College. When John McCain was born, the Panama Canal Zone was a US Territory. Only later, after the Carter presidency, was the Canal Zone handed over to the nation of Panama. Could Carter have handed something over if it didn't belong to the US in the first place? No, he couldn't have. He couldn't have given away something that didn't belong to the USA in the first place.
Persons born in US territories (such as Guam and what was then the US territory of the Panama Canal Zone) are considered natural born US citizens. Further, the child of a US servicemember is considered a natural born citizen even though they were born on foreign soil. The same is true of the child of anybody stationed overseas, whether with the State Dept, DOD, Dept of Agriculture or anyone else posted overseas as part of their duties to the US government. John McCain's father was stationed in the US territory of the Panama Canal Zone at the time of his son's birth, therefore John McCain is a natural born US citizen. Also bear in mind that his mother was over age 19 at the time and was a US citizen herself -- not that that would matter, since McCain's birth status was already covered under his dad's military orders which sent him to the Panama Canal Zone.
It's always interesting to see Obama supporters, on any issue, try to deflect and say McCain did the same thing. When they do so, they 1)don't dispute their own candidate's shortcomings and 2)far from being CHANGE, they admit that Obama is no better than McCain. They admit that they are the same as McCain or at least no better than him. I think the irony is lost on them.
How many of us remember when we were 5 and when caught in the act by our parents we'd say "but Mom/Dad, Billy did it too!" It didn't work then and it won't work now. That's when we were all 5. We're not 5 any more. We're adults now.
The FBI and Secret Service do not "vet" candidates. No way, no how.
That is the responsibility of the respective political parties and of the news media. It is left up to them to make sure they have a presentable, eligible candidate. It is the party's responsibility to conduct a due diligence on the candidates they present on behalf of their party.
It would be rank stupidity and utter chaos for a party to present an ineligible candidate and have that candidate disqualified the day after election day. Can you imagine a capricious FBI or USSS in which they had the power and authority to do such a thing? Do you want the incumbent president, whoever he or she is at the time, to have that power? Remember that the FBI and USSS are part of the executive branch and as such work for the sitting president.
I think there are two parts to the key to this question. #1. Let us see a copy of the handwritten application for certificate of live birth the mother filled out at the courthouse in Hawaii. and,
#2. Let us see the hospital records for 5 days preceding and 5 days after August 4, 1961, for the hospitals in Hawaii where he supposedly was born. Also, let's see the Kenyan hospital records for the same period of time. As I understand it, Barry's uncle and aunt were aware that he was born in a hospital in Kenya.

I find it curious how Obama was the only one who spent time and actively campaigned in Hawaii. He also recently went on vacation there. My suspicion is that there is something fishy about this and the birth certificate thing. Okay, let's get something straight here. Chertoff and others mentioned as dual citizens IS true. However, they DO NOT hold the office of President of the United States. Dual citizenship is allowed in all offices BUT President. This is why Obama got voted as a senator and Arnold the Governor of California. Neither of them, however, can be President.

What is going on here! Is it true that Obama was born in Kenya Africa. Is it true that there are no records of his mother giving birth to him at any hospital in Hawaii.
Is it true that his Grandmother, and half-sister have said he was in fact born in Kenya.
Is it true that Republicans have records to prove Obama was born in Kenya.
And is it true that he was registered as a citizen of Indonesia as a Muslim.

True McCain was born in the Canal Zone and his father was with the US Government, but this does not automatically give him US citizenship. It gives him DUAL citizenship US/Panamanian. At birth he was issued a "Report of Birth" which had to be filed with the American Embassy and he had to obtain a Certificate of Citizenship to prove is US citizenship. Maybe we should check to see if he has one? My son was born in the same hospital under the same circumstances and had to go through all that. We were always told that he could never run for President of the US because he was born outside the country (not that he would ever want to).

This lawsuits keys on Sen Obama's citizenship and I seem to remember some bad Austrian actor being a Governor of the great State of California. It's not the presidency but where were his qualifications earned? On set of T3? A constitutional natural born Citizen is one born within a State in the Union, period. A naturalized Citizen is one of foreign birth, such as McCain, who has the disability of his alienage removed by naturalization (legislation of some kind).
Some think that if a child is born without the States in the Union, then, as long as it is on some military-base, they are a constitutional natural born Citizen. Not so. Case in point, a tenant has equitable title to the property. You walk to the house, they open the door, and you wouldn't be the wiser whether the house was owned by them or not. But, if you check the public records for the deed, you would know if they owned it or not. Similarly, if a military occupies, by consent (such as a lease) of the sovereign (in this case, Panama), a territory, then it has no standing to secure allegiance of children born on such territory any more than it would during hostile occupation (like Iraq). A foreign government is a foreign government, not soverign. If such allegiance was secured by place of birth on military occupied foreign soil, then Hawaiians born between 1898 and 1959 would all be constitutional natural born Citizens. But, the fact is, they cannot be, because the only Citizens referenced in Article II is pure State Citizenship (not Article XIV United States government citizenship and, the subsequent, quasi-State Citizenship) and children born in Hawaii, during that period of solely military occupation, were not born in a State in the Union (http://www.instanthawaii.com/cgi-bin/hawaii?Sover

Even if the United States (do not confuse the government of the Union, to which I refer, with the States in the Union) did claim sovereignty over a territory, then it does not automatically become a State. Take, for example, the territory of the Louisiana Purchase; it was under the sovereignty of the United States and no State in the Union, but it was not a State in the Union and children born there were not eligible for the office of President of the United States. Even the State of Georgia had to quitclaim its property to the United States before the latter could take cognizance of that territory, but it was not yet a State in the Union. Take, for another example, Puerto Rico: if United States soverignty was all that was necessary to create a State in the Union, then the children born on Puerto Rican soil between 1898 and 1917 would all be constitutional natural born Citizens (http://www.boricua.com/facts.htm).
But these Puerto Ricans were not constitutional natural born Citizens. Why? Because Puerto Rico was not a State in the Union. Although the aforementioned site says that Puerto Ricans are US citizens, they are still not de jure Citizens of a State in the Union, and, hence, any child born on Puerto Rican soil is not a constitutional natural born Citizen (note, US citizens are not the Citizens of those articles of the Constitution prior to Article XIV). Try to campaign for a natural born Citizen of Puerto Rico, as the Republicans campaign for John McCain, a natural born Citizen of Panama, for the office of President of the United States, and see how far you get.
Moreover, as this fact obviously confused the author of the instant suit against Obama, the Judiciary of the United States cannot extend the Powers of the Legislature of the United States by merely deciding in their favor: that is not a Power of the Judiciary. Similarly, the Legislature of the United States cannot extend the Powers of the Legislature of the United States by merely legislating on the taboo matter and operating under the color of authority (I don't feel like looking for the Supreme Court reference, so just think about it).
Due to the above fallacious view, some think that the Congress of the United States can alter the Constitution by legislation. That is, they think that a constitutional natural born Citizen is, well, whatever Congress legislates it to be: meaning they think that Congress may exclude those born in Texas from natural born Citizenship, and, thus, the office of the President of the United States, if they so desired. Not so, as Congress may not rewrite or otherwise alter the Constitution: they cannot, in any session, create a monarcy out of the Republic, not, at least, without the de jure consent of the States or the People in observance of Article V :-). A constitutional natural born Citizen is a child born on the soil of one of the several States in the Union, the Legislation and Judgement of the United States notwithstanding.
Also, to facilitate your correct understanding of this matter, an appropriate hueristic is that if legislation of the Congress of the United States is related to the defining of or obtaining of citizenship, then it has to do with the only Power delegated to that body by the Constitution, the Power to establish an uniform Rule of Naturalization (note, you cannot naturalize a natural born, you naturalize a foreign born; and the Power to establish an uniform Rule for the States in the Union does not delegate, to the United States, the Power to Naturalize, such Power is reserved by the States).
Hence, because the United States cannot alter its Constitution, because the constitutional articles prior to Article XIV only recognize de jure Citizens of a State in the Union, because the United States only has the Power to establish an uniform Rule of Naturalization, because neither military occupation by the United States nor claims of soverignty by the United States create a State in the Union, because citizenship by naturalization is not the citizenship by place of birth which is requisite for constitutional natural born Citizenship, and because Panama, including its canal, was not, and is not, a State in the Union, McCain is not a constitutional natural born Citizen, and, thus, not eligible for the Presidency of the United States.

This is not the first time the question has been broached in a presidential election. Fellow Arizonian Barry Goldwater was born in the Arizona territory before it was a state. I wanted to clear something up. I was born in a Naval Hospital in the US. My long form birth certificate is a Federal document signed by a Naval officer with raised stamp. My mother took that and recorded the birth with the city. She was not required to do this. However, the only acceptable record is I can use is the long form Federal document. My record of birth at the city is not considered proof. The point I'm getting at, births at US military bases regardless of location are recorded at the federal level and are not required to be recorded locally whether in the states or not, making that person a cleary natural born citizen. Birth outside of military installations do require registration with a local Consulate, etc...

You go to Yahoo, MSN, CBS/NBC and others, you can clearly see bias in their reporting. But then again, look who's behind Yahoo, MSN, etc. The news is controlling this election, not the American people. They'll be the first to bash McCain/Palin, but something as important as a Presidential Elect that has been served papers in federal court because he was dumb enough to post his half sisters birth certificate on the internet and claim it as his own, is not a matter of news. By virtue of his mother's American citizenship (natural born and reaching waaaay back in the family tree), Obama IS an American citizen by birth. The U.S. Constitution allows that any person born of an American citizen, either on U.S. soil or elsewhere, is entitled to claim citizenship by right of birth. If that person holds dual citizenship by virtue of being born in a nation other than the United States, that person, upon attaining maturity, may choose citizenship of the United States or of that other nation.
Ergo, Obama is a legal, natural born, American citizen. So if you want to dis him, don't do it based on some trumped up Hail Mary effort. If you disagree with his politics, that is something else altogether. But at least have the dignity to voice your POLITICAL opinions and not a blind abhorrance of anything further left than Rove. I am American, then moved to Australia, married and had three children born there. Because I was born in America and, therefore an American citizen, my children were automatically Australian in the eyes of that country, but were also given a birth certificate from the United States which at the very top states "American Born Abroad". They did not have to apply for American citizenship, as they were already a "NATURAL BORN CITIZEN".
Till this day, they hold "dual citizenship".
If, however, I had forfeited my American citizenship before they were born, they would NOT be American citizens in the eyes of the United States.

If you're born in the US you're a citizen automatically. It doesn't take another event (i.e. judicial decree) to make it so.
Someone born abroad of a US Citizen can automatically be granted citizenship by being "naturalized". That doesn't make them "natural born", it's two different things. Unlike "natural born", being "naturalized" doesn't happen unless a judge says so, though the process is fairly automatic if you meet the criteria.
So pay attention. IF Obama was born overseas and IF he never applied for naturalization, then he is NOT a US citizen, natural born, naturalized, or any other flavor. Period.
He can become a NATURALIZED citizen easily enough by applying and proving his parentage. No one disputes that he qualifies for citizenship. But there's nothing he or anyone else can do to become a NATURAL BORN citizen after the fact.

Has anyone checked to see if Obama ever registered for the draft? If he is foreign born, he had to have registered for the draft in order to keep his U.S. citizenship status, or lose it. If he never registered for the draft, he is not a U.S. citizen under any circumstances, and not entitled to U.S. citizen protections.

McCain was born on a US Base to Us parents. he is legal, also the Senate confirmed McCains status a couple of months back. Obama lost his citizenship when his mother re married in Indoniesa and Obama was adopted by his Indonistian fater making him a ctizen of that nation.
Congress does NOT have the power to make a candidate eligible for the presidency if the candidate was not in fact a "natural-born American" at the time of birth.
Even a general-purpose RETROACTIVE award of citizenship to a specific group is probably NOT sufficient qualification for the presidency.
A possible exception would be if the change in the law was made on the basis that the former law was unconstitutional.
Re Obama's citizenship:
Under U.S. law, Obama's citizenship would NOT be lost simply because he acquired Indonesian citizenship through step-parent adoption.
INDONESIAN law did not permit double nationality at the time. If Obama did in fact become an Indonesian citizen through adoption, one of two things must have happened.
(A) Obama's mother or stepfather lied to the Indonesian government, falsely claiming that her and Obama's citizenship had been abandoned. This is the most likely scenario.
(B) Obama's mother ACTUALLY surrendered her and Obama's citizenship by sworn declaration before a U.S. Consular Officer. This is unlikely to have happened, and would have led to complications when Obama returned to Hawaii to attend high school.
On the other hand, Obama's mother did work for UN agencies and in that respect probably would have benefited from having Indonesian citizenship.

Obama is NOT an American citizen because he was born in Kenya AND because his mother was not 19 years old. If she had been, slam dunk.
If they did not "naturalize" him when he was brought from Indonesia to Hawaii, he is not a US Citizen--and NOT eligible to be president (or US Senator or even to reside in the US). It all resides on whether they processed the papers--and so far they have been unable to supply the court with proof. Hence the lawsuit, hence the motions, hence the PANIC in the DNC by Obama supporters. If they could have just produced documents and made this go away, they would have months ago.

Also McCain was born in the Panama Canal on a US Base therefore all US rights and citizenship qualifications are in tact. If B. I'm not racist or close-minded, but my conscience warned me not to trust Senator Obama from the beginning. In light of this new evidence against his citizenship, I feel that my conscience was correct. Sure, he may be very intelligent and capable of running a government office, but it would not be in America's best interest if he is not a "Natural Born Citizen" or even a legal citizen. We have to stick to our constitution, otherwise, we open up the door for all kinds of future problems. You wouldn't slap a bank robber on the hand and tell him not to do it again, no, he is punished for his crime. We shouldn't just dismiss this issue with Sen. Obama (if he is truly guilty of lying about his citizenship) just because some people believe he might make a good candidate for president. Gee, I have my certified copy of my birth certificate in my safety deposit box. I'll bet anyone of us can come up with a certified copy in about 3-5 days. Barack is using a "Diplomatic Passport" so didn't need to supply his Birth Cert.

His mother would have spent at least 5 years in this country after the age of 16 acording to the U.S. Constitution. He was born when she was 18 years 8 months so that he wouldn't qualify as a NBC as you claim.

Actually McCain was granfathered by the legislation that was enacted a few weeks after his birth to give Panama Canal babies born to us citizens citizenship. Before that they and the canal were not recognised as eligible. And since he was born before and not after the legislation he is not a natural born citizen, he is infact naturalized and therefore ineligible to be president. The election commission approved his eligibility because by modern standards and in light of his service to america, he should be eligble.

Anyone can get a copy of your oringinal birht certificate, i had to do this last year and it was a snap- they are all stored and copies from original. so not sure why the DNC has not done thier part to clarify. also if it was true Obama would have used this as his "trump" card in the last 60 days so he would not have had to work so hard- think about it people his is a good talker but never has provided appropriate docs when asked on any single item. period!
Mr. Berg, I would like to know what we, as citizens of the United States, can do to compel Obama to produce a valide birth certificate? Why can't a class action lawsuit be filed on behalf of those of us who want his truthful citizenship to become public? I suggest and request that you please do an update story in the next day or so on the Obama Citizenship Lawsuits. Not much has been written about these cases recently. Your news site is one of the few to cover these cases.
Few Americans and readers now that a 2nd case has just reached the U.S. Supreme Court and has been Docketed before Justice Souter. The 2nd one is the Donofrio Case filed in NJ. The 1st was the Berg vs. Obama case filed in PA. Since both are in the jurisdiction of Souter, he has both of them.

It is probably one of the biggest "opps" within American politics since you have to be a native
born U.S. citizen to take the oath of office for the Presidency.
It has just been revealed that the Democratic National Committee failed to fully check out
Obama's country of origin records. Evidence of citizenship abnormalities has now come to light
that Obama carries native Kenyan citizenship. High ranking DNC sources have admitted that
a serious failure occurred when the committee failed to confirm Obama's actual citizenship of origin.
It has been confirmed that 23 DNC members have been dispatched to Kenya, Hawaii, and Indonesia to
fully confirm Obama's current citizenship status.
In a frantic race against the clock the DNC is now attempting to patch together what everyone
thought they had already done. Copies of birth certificates, voting, arm services and educational records
are being gathered as fast as possible as the DNC scrambles to meet the Dec. 1, 2008 Supreme
Court deadline.
Nevertheless, in recent weeks, multiple lawsuits have been filed in seven additional states demanding
that Barack Obama produce an original vault copy of his birth certificate, to dispel fears that he is
not a natural-born United States citizen.
The latest suits have been filed in state and federal courts all over the U.S. and include Hawaii,
Washington, California, Florida, Georgia, New York, and Connecticut. The suits seek to compel
Obama to release his original vault birth certificate. Currently Obama will only divulge a "Live Birth" copy

see his original vault birth certificate.
Pennsylvania Democrat Philip J. Berg, filed a lawsuit demanding Sen. Barack Obama present proof

lawsuit’s accusations, including the charge that the Democratic candidate was born in Mombosa, Kenya.
On 11/07/08 Philip J. Berg, Esquire, the Attorney filed suit against Barack H. Obama challenging
Senator Obama’s lack of “qualifications” to serve as President of the United States. He filed a Writ of
Certiorari in the United States Supreme Court on October 30, 2008, requesting review of the
United States District Court, Eastern District of Pennsylvania, Judge Surrick’s Dismissal of Philip J. Berg’s
lawsuit against Barack H. Obama, Jr., the DNC and the other co-Defendants.
Accordingly, the U. S. Supreme Court has set dates in which Barack Obama, the DNC and
all co-Defendants are to respond to the Writ, which is on or before December 1, 2008.
